1 BASIS FOR SALE 1.1 Nothing contained in the website constitutes an offer and Sound Foresight Technology Ltd (United Kingdom) reserves the right to withdraw or revise the website and any other material at anytime prior to their acceptance of the buyers order. 1.2 No material or information of any nature whatsoever contained in the website or otherwise communicated to the buyer, other than these conditions shall form part of the conditions governing the contract. 1.3 Sound Foresight Technology Ltd shall not be liable for any advice given by its employees or agents to the buyer as to the application or use of the goods.
2 RETURN OF GOODS 2.1 Sound Foresight Technology Ltd will give a refund on unwanted products within thirty days of delivery of the goods to the buyer, however this does not include refund of shipping or postage charges. This facility incorporates and exceeds the statutory 14-day 'Right to Cancel the Order' under the current distance selling regulations. The offer is subject to the following conditions.... 2.1.1 Goods are returned undamaged, in the condition and packaging they were sold in. Any damage caused to the product which will result in replacing damaged parts for new parts as a result of use or trialling will be deducted from the refund exluding the cost of a new cane tip as we appreciate this will get damaged during any trial or usage. Customers will be advised of any replacement parts used and full photographic evidence is maintained to confirm damaged parts. Sound Foresight Technology Ltd will pay for the return of the goods and will use its own courier company or postal service at its own discretion. 2.1.2 The goods were not specially ordered or modified by Sound Foresight Technology Ltd on the customers behalf. 2.1.3 The goods have not been modified or tampered with. Each product is identified by its serial number and carries a tamperproof seal which must not be broken. 2.1.4 A goods return number has been obtained from Sound Foresight Technology Ltd prior to return of the goods and the Goods are then returned to us in a timely manner. Please see the contact us page for our details. 2.1.5 The customer is not responsible for paying return postage to our UK address if they are a resident in the EU or UK. All other overseas customers are required to pay for the return of the product/s to Sound Foresight Technology.
3. CANCELLATION POLICY The customer may cancel a pending order and receive a full refund at any time prior to the despatch of goods and within 14 days of placing the original order. Once goods have left us, an unwanted order may be returned to us under the terms of our Return of Goods policy (see section 2 above).
4 LIABILITY 4.1 Subject to the conditions set out below Sound Foresight Technology Ltd warrant that the goods correspond with the manufacturers specifications at the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date of delivery of the goods to the buyer. Please note that none of these provisions affect your statutory rights under the sale of goods act 1979. 4.2 Sound Foresight Technology Ltd shall be under no liability in respect of any defect in the goods arising from fair wear and tear, neglect, failure to follow Sound Foresight Technology Ltd's instructions for use, misuse or improper alteration or repair of the goods by the buyer. 4.3 The warranty in 4.1 does not extend to parts, materials or equipment not manufactured by Sound Foresight Technology Ltd or its partners, in respect of which the buyer shall only be entitled to the benefit of any such warranty or guarantee given by the manufacturer to Sound Foresight Technology Ltd, and which we will in so far as possible, assign to the buyer upon the written request of the buyer.
5 EXEMPTION 5.1 Except as expressly provided for in this contract and subject to the requirements of the Unfair Contract Term Acts 1977, Sound Foresight Ltd makes no warranties whatsoever expressed or implied, oral or written to the buyer for: 5.1.2 Consequential or indirect loss or damage (including loss of profit), however arising; 5.1.3 Sums in excess of the price of the goods to which the claim relates.
6. THE WEBSITE 6.1 Sound Foresight Technology Ltd is the owner of the copyright content in the website and no part of the website may be reproduced in any material form (including without limitation, photocopying or storing it in any medium by electronic means) without the written consent of an authorised representative of Sound Foresight Technology Ltd. 6.2 All information, details and illustrations in the website have been carefully prepared to avoid error but the accuracy of such information is not warranted and such information, details and illustration, do not form part of this contract. Sound Foresight Technology Ltd shall not be liable for any loss or damage resulting from any errors, omissions or typographical errors in the website. 6.3 All pictures are for reference purposes only.
7. SEVERANCE 7.1 If any provision of these terms and conditions or any part thereof is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected thereby. The contract will be construed in accordance with and governed by the laws of England and each party agrees to submit to the jurisdiction of the courts of England. Our policy is one of continual improvement. We reserve the right to make alterations without notice.
8. WARRANTY We're sure you will be very happy with your UltraCane purchase but if you have a problem please contact us in the first instance so we can try and remedy it for you. All UltraCanes and accessories come with a full 12 month warranty. This covers manufacturing defects and faulty parts, but excludes problems caused through normal wear and tear or damage resulting from using the UltraCane or accessories beyond their intended function. Please also note the conditions in Liability section 4 above. If you need to return your UltraCane during the 12 month warranty period, upon receipt we will repair it or if it cannot be repaired, then we will replace it. In the first instance though, please call our sales office so that we can identify your UltraCane and review any problems that you are having with it. If we cannot resolve the problem we will give you a unique identity code and explain to you how you will need to return the UltraCane to us.
9. DELIVERY POLICY We aim to fulfill all orders from stock. Our normal delivery policy is to despatch goods within 2-3 days of receipt of order.
